Terms of Service

These Terms of Service ("Terms") govern access to and use of the software, websites and applications provided by Niravi Health ("Niravi", "we", "us") (the "Service"). By using the Service you agree to these Terms.

1. The Service

Niravi provides clinic and hospital management software to healthcare providers ("Customers") and their authorised users. The Service is a tool that supports clinical and administrative workflows; it does not provide medical advice and does not replace the professional judgement of a qualified clinician.

2. Accounts & eligibility

Users must be authorised by a Customer organisation, keep their credentials confidential, and use the Service only for lawful, legitimate healthcare and business purposes. The Customer is responsible for the activity of its users and for the accuracy of the information it enters.

3. Customer data & responsibilities

Customers retain ownership of the data they enter. Customers are the data controllers / fiduciaries for patient information and are responsible for obtaining the consents required by law (including for record exchange and communications) and for using the Service in compliance with applicable medical-record, privacy and advertising-platform rules. Niravi processes such data as described in our Privacy Policy.

4. Connected third-party services

Customers may connect third-party services (for example Meta or Google advertising accounts, or the ABDM network). Use of those services is also subject to the third party's own terms and policies. The Customer is responsible for having the rights and permissions needed to connect such accounts.

5. Acceptable use

You agree not to misuse the Service, including by attempting to breach security, access data without authorisation, disrupt the Service, or use it to violate any law or third-party right.

6. Availability

We work to keep the Service reliable but do not guarantee uninterrupted availability. Maintenance, updates and factors outside our control may affect access.

7. Disclaimers & limitation of liability

The Service is provided "as is" without warranties of any kind to the extent permitted by law. Niravi is not liable for clinical decisions made by users. To the maximum extent permitted by law, Niravi's liability arising from the Service is limited as set out in the applicable written agreement with the Customer.

8. Termination

We may suspend or terminate access for breach of these Terms or to protect the Service or its users. On termination, data handling follows the Privacy Policy and any applicable written agreement.

9. Governing law

These Terms are governed by the laws of India, with jurisdiction in the courts of the applicable registered place of business.

10. Changes

We may update these Terms from time to time; material changes are reflected by the "Last updated" date.
